Introduction

These Terms and Conditions (the “Terms”) constitute a legally binding agreement between BuyParfum LLC (“BuyParfum,” “we,” “our,” or “us”) and any natural person or legal entity (“you” or the “Customer”) accessing, browsing, or purchasing products through our website, mobile interfaces, and any associated digital services (collectively, the “Site”). 4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation Requirements

You agree to maintain and promptly update your information to ensure its continued accuracy. Providing false or misleading data constitutes grounds for termination.

5.1 Product Descriptions

We endeavor to ensure that all Product descriptions, images, and pricing displayed on the Site are accurate. However, minor variations may occur due to photography, screen display differences, or manufacturing updates.

5.2 Bottling & Batch Variation

Fragrances may exhibit natural variations between batches. Such variations—including subtle differences in color, projection, or longevity—do not constitute defects.

5.3 Allergies & Sensitivities

Customers with known allergies or sensitivities should review ingredient lists and use Products with caution. We disclaim liability for adverse reactions unless caused by proven manufacturing defects.

5.4 Authenticity Statement

BuyParfum sells Products sourced, manufactured, or produced exclusively by or for our brand. No representation is made regarding affiliation with unrelated third-party luxury brands unless explicitly stated.

5.5 Product Availability

We may limit or discontinue Products at any time. Stock levels displayed online are estimates and do not guarantee availability.

6. PRICING, TAXES & CURRENCY

6.1 Displayed Prices

All prices shown on the Site represent the retail price for each Product at the time of listing and are subject to change without notice.

6.2 Currency Formats

Prices may be displayed in USD, AED, or other currencies depending on your location or selections made on the Site. Final billing currency is dictated by your payment method provider.

6.3 Taxes, Duties & Customs Charges

BuyParfum disclaims liability for losses arising from payment processor outages, disruptions, or security incidents beyond our reasonable control.

8.4 Payment Disputes & Chargebacks

In the event of a disputed charge, you agree to first contact us to attempt resolution before initiating a chargeback with your financial institution. Unfounded or fraudulent chargebacks may result in suspension of your Account, cancellation of pending Orders, and potential recovery actions.

9. SHIPPING, DELIVERY & RISK OF LOSS

9.1 Shipping Methods and Carriers

We ship Products through reputable carriers selected at our discretion. Available shipping methods, estimated timeframes, and applicable shipping fees are displayed at checkout.

9.2 Flammable Goods / Air Transport Considerations

Perfumes and body mists are classified as flammable liquids under international transport regulations. As such, certain destinations, carriers, or shipping methods may be restricted or unavailable. Delivery delays may result from mandatory safety checks or customs inspections.

9.3 Delivery Estimates & Delays

All delivery timeframes are estimates only. While we endeavor to meet stated timelines, delays may occur due to customs controls, carrier disruptions, global logistics issues, or peak seasonal demand. Such delays do not constitute breach of contract.

9.4 Risk of Loss & Transfer of Title

Risk of loss, damage, or theft transfers to you once the carrier confirms delivery to the address provided at checkout. Title to the Products transfers only upon full payment of all amounts due.

9.5 Failure to Receive Delivery

If a parcel is returned to us due to incorrect address information or failure to accept delivery, you may be responsible for redelivery charges or forfeiture of the Order. Refunds, if any, will be processed in accordance with our Refund Policy.

10. INTERNATIONAL ORDERS & CUSTOMS COMPLIANCE

10.1 Country Restrictions

11. RETURNS, EXCHANGES & REFUNDS

11.1 Eligibility Criteria

Returns or exchanges are accepted only in compliance with the criteria published in our Refund & Exchange Policy. Generally, Products may be returned if:
(a) the incorrect item was received;
(b) the item arrived damaged or defective; or
(c) the Product remains unused, sealed, and in resalable condition (if permitted under Applicable Law).

11.2 Return Window

Eligible returns must be initiated within ___ days from delivery. This period may vary depending on your jurisdiction’s consumer-protection laws.

11.3 Non-Returnable Items

For hygiene and safety reasons, opened or used fragrances cannot be returned unless Proven Defect criteria are met. Clearance items, promotional bundles, and samples may be final-sale.

11.4 Return Shipping Costs

Unless the return arises from our error, you are responsible for return shipping costs. We may, at our discretion, waive or subsidize return fees for specific territories or order values.

11.5 Refund Processing

Refunds are issued to the original payment method once the returned Product is inspected and approved. Processing times depend on your financial institution and may take several Business Days.

11.6 Exchanges & Store Credit

Where available, exchanges may be arranged for the same Product variant or an alternative of equal or higher value. Store credit may be offered as a discretionary alternative.

12. PROMOTIONAL CODES, SALES & DISCOUNTS

12.1 Coupon Code Validity

Promotional codes, including introductory offers such as the newsletter’s 10% discount, apply only to qualifying purchases and cannot be redeemed for cash.

12.2 Newsletter Discount

The first-order discount is valid for new subscribers only and may be subject to minimum spend requirements. The code must be applied at checkout and cannot be retroactively added.

12.3 Restrictions on Stacking

Unless expressly stated, discount codes cannot be combined. Promotional pricing, clearance markdowns, or seasonal sales may render certain coupon codes invalid.

16.3 Moderation & Removal Rights

Your experience with scent longevity, projection, or performance may vary based on skin type, environment, and natural batch variations. Such variance does not constitute defect or non-conformity.

20.3 No Medical or Therapeutic Claims

Products are cosmetic goods only. We do not represent that any Product has therapeutic, medicinal, or dermatological benefits.

20.4 Third-Party Manufacturer Information

Where Products or ingredients originate from suppliers, we rely on representations provided by such third parties and disclaim liability for inaccuracies not reasonably detectable.

21. INDEMNIFICATION

21.1 Customer Duty to Indemnify

You agree to indemnify, defend, and hold harmless BuyParfum, its directors, officers, employees, partners, and affiliates from any claim, demand, loss, liability, damage, or expense (including legal fees) arising from:
(a) breach of these Terms;

22. SUSPENSION, TERMINATION & ACCOUNT CLOSURE

22.1 Right to Suspend Services

We may suspend access to the Site or specific functionalities if required to protect system security, comply with legal obligations, or address suspected fraud or abuse.

22.2 Termination for Breach

We may terminate your Account or restrict your access without prior notice upon breach of these Terms or conduct that harms our brand or customers.

22.3 Effect of Termination

Upon termination, your right to access the Site ceases immediately. Outstanding payment obligations and accrued rights survive termination.

22.4 Survival of Key Provisions

Sections relating to intellectual property, limitations of liability, indemnification, governing law, and other clauses intended to survive termination shall remain in force.

23. GOVERNING LAW, JURISDICTION & DISPUTE RESOLUTION

23.1 Governing Law

These Terms and any dispute or claim arising out of or relating to them shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict-of-law principles. For clarity, the Company’s Dubai office shall serve as the primary legal and administrative headquarters for all dispute handling and contractual matters.

23.2 Venue for Disputes

Subject to Section 23.3, any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or any Product shall be submitted exclusively to the competent courts of Dubai, United Arab Emirates, which shall have sole and exclusive jurisdiction.

23.3 Informal Resolution & Arbitration

Before initiating formal legal proceedings, the parties agree to attempt in good faith to resolve the dispute informally for a period of at least 30 days. Where legally permissible and mutually agreed in writing, the parties may submit disputes to binding arbitration before a single arbitrator in Dubai, UAE.

23.4 Consumer Rights

If you are a consumer, mandatory consumer protection laws in your jurisdiction may apply and may override certain provisions of this Section to the extent required by law.

24. NOTICES & COMMUNICATIONS

24.1 Method of Notice

Official notices may be delivered via:
(a) email to the address you provided;
(b) postings on the Site; or
(c) courier or registered mail to your billing address.

24.2 Electronic Communications Consent
